Chapter 140: Occupancy Permits

§ 140-1 Occupancy Permits – Permit required.

No person, persons, firm or corporation shall move into or occupy any dwelling, building or other structure within the Borough of Mahanoy City without first having obtained a permit therefor from the Borough Code Enforcement Officer.
This violation must be corrected, and permit obtained within 3 days.

 Permits can be obtained at Borough Hall, Located at 239 E Pine St., during normal business hours. Permit fee is $30 and 2 forms of identification for all occupants over the age of 18 is required.

Chapter 156: Rental Properties


§ 156-8 Registration required; specifications.

No owner or agent shall own or operate a residential rental unit unless and until a current registration license, for each specific unit and use thereof, has been issued to the owner or agent by the Borough of Mahanoy City pursuant to Chapter 156 of the Borough Code.
This violation must be corrected, and registration obtained within 3 days.

Chapter 121: Housing and Property Maintenance

§ 121-2 (E) (3) Dangerous Structure.

For this code, any structure or premises that has any or all of the conditions or defects described below shall be considered dangerous: Any portion of a building, structure or appurtenance that has been damaged by fire, earthquake, wind, flood, deterioration, neglect, abandonment, vandalism or by any other cause to such an extent that it is likely to partially or completely collapse, or to become detached or dislodged.
This violation must be corrected within 30 days.

§ 121-8 (A) Exterior Structure.
The exterior of a structure shall be maintained in a good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare.
This violation must be corrected within 15 days.

§ 121-6 Exterior Property Areas.
(A) Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition.
This violation must be corrected within 5 days.

(D)(1) Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of six inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens.
This violation must be corrected within 3 days.

Chapter 64: Animals

§ 64-2 Keeping of domestic animals.
No domestic animals shall be permitted to run at large within the borough limits of the Borough of Mahanoy City, Pennsylvania, and all domestic pets must be kept on the property of the owner thereof or must be kept on a leash and must be maintained in a clean and sanitary condition.
This violation must be corrected within 3 days.

§ 64-5 Running at large.
(A) Any dog running at large in violation of the provisions of the Dog Law of 1965 (3 P.S. §460-101 et seq.¹) or any dog in violation of this chapter of the Code of the Borough of Mahanoy City shall be subject to seizure, detention, and disposal as provided in the Dog Law of 1965.
 (B) Any other domestic animal running at large in violation of the provisions of this chapter of the Code of the Borough of Mahanoy City shall be subject to seizure, detention, and disposal.

§ 64-10 Number restricted; exceptions.
It shall be unlawful to keep more than three dogs, cats or any other pets on any premises, regardless of the number of owners. It is the intention of this section to limit the number of such pets to three, regardless of whether they are dogs, cats or any other animals, or any combination thereof. This section shall not apply to fish or turtles kept in aquariums. This section shall not apply to any premises for which a kennel license has been obtained pursuant to the Dog Law of 1965 (3 P.S. § 460-208 et seq.) This provision shall not apply to animals which have been owned prior to the effective date of this article.
This violation must be corrected within 3 days.

§64-12 Prohibition.
All persons owning or keeping a dog or other domestic animal are hereby prohibited from allowing said dog or other domestic animal from defacating in any public place or on private property not owned by said owner or keeper, unless said dog owner or animal owner immediately removes the excrement from the place where it was deposited by his or her animal.
This violation must be corrected within 3 days.
